1Definitions
- Provider (called the Company in the section "Regions and third-party services") — ARTIFICIUM (ARTIFICIUM, Tax ID AD555295), the rights holder of Gargona. The Provider's details are in the section "Details and contacts".
- User — a person with full legal capacity who has accepted this offer. A User acting for a company confirms that they may accept the offer on its behalf.
- Gargona, the Service — the program for a Windows computer (the "studio") and the website with the account area.
- Account area — the User's personal account on the Gargona website.
- Own brain — an AI model the User connects themselves. In Gargona 1.0 it is Claude through Claude Code on the User's own Claude Pro or Max subscription.
- Freemius — the merchant of record: it takes the payment on its own page, issues the invoice and handles refunds.
- Studio subscription — access to the studio for a month or a year with auto-renewal that can be cancelled.
- Founders — access to the studio for life ("Founders · lifetime") or for one year without auto-renewal ("Founders · Year"), sold during the pre-sale.
- Licence — an electronic access key that the website issues to the app on a linked computer.
2Subject of the offer
The Provider grants the User a simple non-exclusive licence to the Gargona Studio program for the term of the trial, the Studio subscription or Founders, and the User pays for the Studio subscription or Founders.
The program may be used on no more than [2] computers at a time. The limit is shown in the account area, where computers are also unlinked.
The exclusive rights to the program, its design, texts and guides belong to the Provider. The licence does not allow copying, selling, renting out or transferring the program to third parties, or decompiling it, except where the law expressly allows it.
3Acceptance
The offer is accepted when the User clicks "Accept" on the first launch of the program or at sign-up, pays for the Studio subscription or Founders, or activates a key ([article of the Civil Code of the Republic of Uzbekistan on public offer and acceptance — to be confirmed by a lawyer]).
By accepting the offer, the User confirms that they have read it, the Privacy Policy, the Refund Policy, the Content Rules and the document "How we use AI", and that they are at least [16] years old.
4Trial
- The Studio trial is 7 days of every studio feature on the first computer the User links to the account. It is given once per account and once per computer.
- No bank card is needed for the trial, and nothing is charged automatically after it.
- After the trial, work in the studio continues with the Studio subscription or Founders.
5Prices and payment
Prices are shown on the "Pricing" page in US dollars. The price is fixed at the moment of payment; the buyer's country tax, if any, is shown on the payment page before paying.
Payment is possible only in the account area on the website. The desktop program does not take money: the buy buttons open the account area.
Payments are taken by Freemius, the merchant of record. The payment happens on the Freemius page; Freemius issues the invoice and handles refunds. The Provider does not receive or store bank card data.
Payment from Russia and Belarus is not available yet. The Studio subscription or Founders starts as soon as Freemius confirms the payment.
6Changes to prices
- A price increase applies to new subscribers. An existing subscriber keeps their price for 12 months from the date of the increase, and a yearly subscriber for one more renewal at the old price.
- The Provider gives at least 30 days' notice of a change to the subscription price; a period already paid for runs at the old price.
- Notices are published in the account area and sent to the account's contacts.
7Auto-renewal
The Studio subscription renews automatically through Freemius at the end of each paid month or year. Founders · Year does not renew: access under it ends after the year.
Renewal can be cancelled at any time with the "Cancel auto-renewal" button in the account area; access stays until the end of the paid period.
If a renewal payment fails, access stays for the grace period shown in the account area; after that the licence is paused until payment.
8Founders
Founders is sold only in the account area, during the pre-sale until 07.03.2027, 23:59 Tashkent time: "Founders · lifetime" in a run of 300 seats (№1–100 and №101–300 at different prices), "Founders · Year" without a run.
Founders includes access to Gargona Studio, a member number and the same computer limit as the Studio subscription. "Lifetime" means the studio in the latest version of Gargona released while the Service operates. "Year" means access for one year from the date of payment, without auto-renewal.
If the Provider stops operating the Service, "Founders · lifetime" members will receive a perpetual offline licence or a build without licence checks, and the ability to export their projects.
Anthropic's rules may change how Claude is connected. Such changes do not stop the studio's features on the computer from working.
9Keys
- Keys are issued only by the Provider. Before activation the Account area shows what the key gives and which account it will go to; the key is activated only after the User clicks.
- A key is activated once and is bound to an account. Keys may not be sold, exchanged or published.
- The Provider may revoke a key obtained or used in breach of these rules; access through it then ends.
10Claude and third-party services
Gargona 1.0 works with the User's own brain: Claude through Claude Code on a Claude Pro or Max subscription. The Claude subscription is not included in the Gargona price and is paid to Anthropic separately.
The User may connect other services to the studio with their own accounts, on those services' terms and prices; the Provider charges nothing for calls to services on the User's accounts. The Provider's cloud plans (Creator, Producer, Agency) come later and are not sold now.
The Provider is not responsible for the availability, quality or prices of third-party services. How third-party services work in different countries is described in the section "Regions and third-party services".
11Regions and third-party services
1. Gargona works with AI models and services of third parties (hereinafter, third-party services), for example Anthropic (Claude), OpenAI, Google, ElevenLabs, Tripo. The user connects them themselves — with their own accounts, subscriptions or keys — or uses them through the Company's cloud services.
2. Third-party services work under their own terms. Some of them do not serve users who are located in certain countries and regions. For example, under Anthropic's supported regions policy, in force from 12.11.2026, Claude may not be used while located in Russia or Belarus, including through services of other companies.
3. The Company does not limit which third-party services the user connects with their own accounts, subscriptions and keys. By connecting such a service, the user:
- a) checks and complies with the terms of that service and the laws of their country and of the country where they are located;
- b) understands that the provider may block or close their account, delete the data in it and not refund money;
- c) bears this risk themselves. The Company is not liable for the blocking, closing or restriction of the user's accounts with third parties, or for the loss of data in them or money paid to third parties, unless caused by the Company's breach of this offer.
4. The Company does not help to circumvent restrictions of third-party services, gives no instructions and does not advise on ways to circumvent them: changing region, tools for bypassing blocks, other people's or foreign means of payment, other people's accounts.
5. Cloud services that the Company provides through its own accounts with providers (the cloud brain, generation through the Gargona gateway, cloud rendering, YouTube API features, etc.) are provided within the terms of those providers and sanctions rules. If the user is located where a provider does not operate, the Company fulfils the request through another provider or model — marked in the result — or reports that the service is not available there yet. The Company determines the location by the country the user stated, the country of the payment method and the country of the IP address at the time of the request. The IP address itself is not stored.
6. The user does not give the Company a false country of location in order to receive the services of p. 5 through a provider that does not operate in their country. In case of a breach the Company fulfils such requests through other providers, and in case of a repeated breach may suspend cloud services or terminate the contract (refunds — under the section "Refunds").
7. The Company's cloud brain may not be used on the instructions of a company registered in a country that Anthropic does not support, or controlled by persons from there.
8. Gargona may not be used in territories under comprehensive sanctions (the list is in the appendix to the offer). There the Company does not sell access, open accounts or provide cloud services.
9. The "Where things work" table: which of the Company's cloud services go through which providers in which regions; links to the providers' rules; date of the last check.
12YouTube
Gargona features that work through YouTube API Services (Google sign-in for your own channel, analytics of your own videos, information about public videos, uploading a finished video to your own channel) are subject to the YouTube Terms of Service: https://www.youtube.com/t/terms. By using them, the User agrees to these terms.
Gargona does not download or store YouTube audio or video. Another creator's video is added to a project as a link marker with timecodes and watched in the official embedded player; markers never go into exports or uploads.
A video is uploaded to YouTube only after the User confirms that specific video: title, description, visibility and publishing time.
How Google processes data is described in the Google Privacy Policy: http://www.google.com/policies/privacy. Gargona's access to a Google account can be revoked at https://security.google.com/settings/security/permissions.
13User obligations
The User undertakes:
- to follow the Content Rules;
- not to give access to the account or the licence to third parties;
- not to circumvent the program's technical protection, limits or licence checks, and not to interfere with the website and cloud services;
- not to state a false country of location and not to impersonate another person;
- not to use the Service to break the law or the rights of others, including copyright;
- to be responsible for the material they upload, create and publish.
14User material
Projects and media files are stored on the User's computer: Gargona does not upload them to the Provider's servers. The Provider acquires no rights to the User's material or the results of their work.
The frames and text Claude looks at while working go to Claude under the User's subscription, on Anthropic's terms.
Third-party material enters a project only by the User's decision. The User states the file's source and legal basis (licence, permission, quotation) and guarantees that they hold the rights to it.
15Copyright complaints
Complaints about infringement are accepted by e-mail at the address in the section "Details and contacts"; the procedure is described in the Content Rules. The Provider replies within 2 business days.
On a justified complaint, the Provider removes the disputed material placed through its services. For a repeat infringer, the Provider closes access to these services and may terminate the contract (section "Suspension and termination").
16Liability
The Service is provided "as is". The Provider makes reasonable efforts to keep it working, but does not guarantee that it is free of errors.
The Provider's liability is limited to the amount the User paid the Provider during the last [12] months, unless the law provides otherwise.
The Provider is not liable for losses caused by failures of third-party services, internet providers or the User's equipment, or for third-party providers' decisions about the User's accounts (section "Regions and third-party services").
These limitations do not apply where the law of the User's country does not allow them.
17Suspension and termination
The User may stop using the Service at any time and delete the account in the account area. Deletion takes effect after 7 days; until then it can be cancelled.
The Provider may suspend access or terminate the contract for a material or repeated breach of the offer or the Content Rules, warning the User first if the breach can be remedied. A repeat infringer is a User who has received [3] justified copyright complaints within [12 months].
On termination, money for the unused period is refunded under the Refund Policy, unless the law requires otherwise.
18Refunds
The refund procedure is described in the Refund Policy, which is part of this offer. Freemius returns the money by the same method that was used to pay.
19Changes
The Provider may change the offer by publishing a new version on the website at least [10] days before it takes effect. The Provider gives at least 30 days' notice of a subscription price increase; the price of a period already paid for does not change.
If the User does not agree with the new version, they may cancel renewal and request a refund under the Refund Policy.
20Governing law and disputes
The relations of the parties are governed by the law of [the Republic of Uzbekistan — to be confirmed by a lawyer]. Disputes are settled by negotiation and, failing that, in the court at the Provider's location, unless the law provides for another jurisdiction.
A User who is a consumer keeps the rights given by the mandatory law of their country of residence.
