1Scope
These rules apply to everything the User creates, uploads and publishes with Gargona: cloud generations and tasks, files in the cloud, Hub pages, the bot and uploads to platforms. The Provider does not look at projects on the User's computer.
2What is prohibited
- any sexual material involving minors, including generated material;
- sexual material with real people without their consent, and imitations of real people's appearance or voice made to deceive or harm;
- calls for violence, terrorism, extremism and incitement to hatred;
- fraud, phishing, fake documents and reviews presented as genuine;
- infringement of copyright and related rights, trademarks and a person's right to their image;
- harassment and disclosure of other people's personal data;
- instructions for making weapons capable of mass harm;
- material prohibited by the law of the User's country or the country of publication.
3Providers' rules
Generations through the Gargona gateway are also subject to the model providers' usage policies and moderation. A provider may reject a request; Gargona then shows the refusal and the credits are refunded as for a provider error.
4AI labels
Gargona records the origin of every generated clip in the clip's passport. The User labels realistic material created or altered by AI wherever platform rules or the law require it.
5Other people's material
Other people's videos, music and images may be used only with the rights to them. A YouTube video is added as a link marker to the official player, not as a file. The User states the source of a file and the legal basis (licence, permission, quotation).
6Copyright complaints
- Send complaints to [address for copyright complaints].
- Include: who you are and on whose behalf you act; which work is infringed; where the disputed material is (a link or ID); why its use infringes rights; your contact details; a statement that the information is accurate and that you act in good faith.
- We reply within 2 business days. On a substantiated complaint we remove Hub links, cloud files and uploads on the file transfer page, and notify the User, who may send a reasoned objection.
7Repeat infringers
If [3] substantiated copyright complaints against a User are received within [12 months], the Provider blocks their cloud services and Hub pages and may terminate the contract (offer, section "Suspension and termination").
8How we review
Requests to generation models are checked by the providers' moderation. Material that has been reported is reviewed by a person. We do not look at projects on the User's computer.
9How to report a violation
Violations of these rules can be reported to [email address] or the support bot [@support].
